The U.S. Supreme Court on Monday opened another front in the long-running battle over affirmative action by agreeing to decide the constitutionality of Michigan's ban on the use of race in admissions at its public colleges and universities.

    Let's see if I understand Mr. Chemerinsky's tortured logic? He is saying that it is a difficult question for him whether removing racial preference for one group over others (affirmative action) is itself a form of racism. Does he also think the answer is difficult? By extension, he would likely find that Martin Luther King's hope that men would someday be judged by the content of their character rather than by the color of their skin will also result in a form of racism.
