    Chemerinsky may be a big name in legal academic circles but he is not a good choice for Berkeley Law. There are three primary concerns. First, it is unusual and rare to fill a Law Dean vacancy by grabbing the Dean of another Law School because you fill one Law Dean vacancy by immediately creating another. Secondly, you are taking one of the biggest names in legal academic circles and you are turning him into a beggar. The only reason he is going from Irvine Law to Berkeley Law is that Berkeley Law has been around for a lot longer and its alumni are far more numerous. And far more prosperous. All he is going to be doing is begging those alumni for contributions. Contributions to build a building that will cost $85 million. Irvine Law has an alumni of 460 while Berkeley Law has 17,000 alumni. You are degrading one of the top legal minds in the country by asking him to beg 17,000 people. These former law students once looked up to him as a nationally respected legal scholar. Now they will despise him. Thirdly, after the very recent sexual harassment charges that were filed against Chemerinsky‘s predecessor and the resulting national and international embarrassment that Berkeley Law endured, the time is ripe for a dickless Dean. Berkeley Law is in dire need for a woman with grace and dignity at the helm. Given the huge settlement that was awarded to the accuser of Chemerinsky‘s predecessor, many a female law student will surely smell an opportunity for a huge payout with any incoming male Dean. And if she is hot, she will work on him. For many a female law student it is all about the cash. Women who teach in law schools should be first in line for Deanship vacancies that occur when a male Law Dean becomes a sexual predator. The legal profession has no shortage of women in academia who are graceful and elegant. NYU‘s Jennifer Arlen would make any Law School proud as Law Dean.

    Dean Chemerinsky will undoubtedly take Boalt Hall to even greater heights. I worked closely with Dean Chemerinsky as co-counsel in an important SCOTUS case. Throughout our professional relationship, his brilliance and practical gift for lawyering were readily evident. And his legal scholarship was second to none. His quality of constitutional scholarship directed to promoting broad protections of the democratic process reminds me of Prof. John Hart Ely, another former Law Dean (Stanford) and Professor Emeritus and Endowed Chair at the University of Miami School of Law. Berkeley Law and the entire University of California establishment will be greatly enhanced by Dean Chemerinsky‘s elevation.
