Foley Partner Defends 'Unorthodox' Brief in Supreme Court Disciplinary Action


Lawyers for Foley & Lardner partner Howard Shipley on Thursday pushed back against the U.S. Supreme Court’s threat to sanction him for a jargon-filled petition he filed in a patent case last year, telling the justices that although it was "unorthodox" in style, the petition "clearly and faithfully reflects" his client's views.

    Although Clement urged the high court not to sanction Shipley for following the wishes of his client, asserting that if Shipley had withdrawn from the representation, a successor lawyer would not have been able to file the cert petition, he then argued that the appropriate remedy is rejection of the petition, and not sanctioning the signing attorney. After reading the first page of the response, all I could say was a stunned "wow".
