An administrative law judge in a matter recently applied, albeit reluctantly, the National Labor Relations Board's controversial rule prohibiting an employer from even asking employees making a complaint not to discuss the matter with their co-workers.

    Even before I became a lawyer 35 years ago I steadfastly believed that employers should not be directing employees from discussing their pay (and other conditions) with fellow employees.

    Maybe this would be a good time for a recess re-appointment, not that Mr. Boehner is out playing on the swingset.
